FaceSwapper Affiliate Program Terms & Conditions

Welcome to the FaceSwapper Affiliate Program! By joining our affiliate program, you agree to comply with the following terms and conditions. Please read them carefully.

1. Enrollment in the Affiliate Program

To enroll in the FaceSwapper Affiliate Program, you must submit a completed application through our affiliate sign-up page. We reserve the right to accept or reject any application at our sole discretion.

2. Affiliate Responsibilities

As a FaceSwapper affiliate, you agree to:

• Promote FaceSwapper in a positive and ethical manner.
• Avoid any misleading, false, or inappropriate content in your promotions.
• Comply with all applicable laws and regulations, including but not limited to data protection and privacy laws. 

3. Commission and Payment

• Commission Structure: Affiliates earn a 30% commission on every sale made through their unique affiliate link. Your referrals will also receive a 20% discount on all FaceSwapper premium plans.
• Cookie Duration: When a potential customer clicks on your referral link, a cookie is stored in their browser to track your referral. The cookie is then stored for 60 days to give your referred customers time to decide if they wish to purchase FaceSwapper. 
• Payment Terms: Commissions are paid monthly via PayPal. Payments are made on the 15th of each month for the previous month's earnings. There is a minimum payout limit of $50. If your earnings do not reach this threshold, they will be carried over to the next month.
• Available Plans: Affiliate commission is applicable on FaceSwapper’s monthly and yearly plans. And what you can actually earn is based on the rate the end customer purchases at. 

4. Self-referrals are Strictly Prohibited

You cannot refer to yourself, and you will not receive a commission on your own accounts. There is also a limit of one commission per referral. If someone clicks the link on your site and orders multiple accounts, then you will receive a commission on the first order only. 

5. Commission Rejections

Payments will only be sent for transactions that have been successfully completed. If a purchase is refunded, a commission won’t be paid out for that referral. We reserve the right to reject affiliate commissions for any reason. 

Commission rejections may occur for the following reasons: 

• The sale that the referral was based on was refunded 
• The method by which the referral was generated was in violation of our promotional policies (see below) or violated the spirit of the Affiliate Agreement. 

6. Promotion and Marketing

Affiliates are encouraged to promote FaceSwapper through various channels, including social media, blogs, email marketing, and influencer partnerships. However, the following promotional methods are prohibited:

• Paid search engine marketing using the FaceSwapper brand name.
• Any form of spam or unsolicited commercial email (UCE).
• Misleading or false advertising. 
• Deal or coupons sites. 

7. Affiliate Link and Tracking

Upon acceptance into the program, you will receive a unique affiliate link. This link contains tracking information to attribute sales to your account. You are responsible for ensuring that your affiliate link is correctly implemented and functioning.

8. Termination

Either party may terminate this agreement at any time, with or without cause, by giving the other party written notice. Upon termination, you will cease all promotional activities related to FaceSwapper and remove all affiliate links and marketing materials from your site.

9. Modification

FaceSwapper reserves the right to modify any of the terms and conditions within this agreement at any time. Affiliates will be notified of any changes via email or through our affiliate dashboard. Continued participation in the program following such notification constitutes your acceptance of the revised terms and conditions.

10. Limitation of Liability

FaceSwapper will not be liable for any indirect, incidental, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this agreement or the affiliate program, even if we have been advised of the possibility of such damages.

11. Disclaimers

We make no express or implied warranties or representations with respect to the affiliate program or any products sold through the program (including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage).

12. Governing Law

This agreement shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law principles.

13. Inappropriate Websites

• Sites that contain defamatory, harassing, harmful, obscene, racially discriminatory or illegal content.
• Sites that display adult material or banners.
• Sites that promote violence, hatred or bigotry.
• Sites that promote or engage in illegal activities, including (but not limited to) hacking, cracking, invalidating and warez sites.

14. Affiliate Platform Statement 

FirstPrompter is the only platform where we host the FaceSwapper affiliate program. We are not affiliated with or responsible for any marketing activities conducted by any other affiliate platform on behalf of FaceSwapper. 

15. Term of the Agreement

The term of this Agreement will begin upon our acceptance of your Affiliate Program application. We may modify the terms and conditions of this agreement at any time. Your continuing participation in the Program will constitute your acceptance of any change.

16. Privacy and Data Protection

With respect to the personal data entered by the Affiliate when applying for our Affiliate Program and/or contacting us, we act in the capacity of Data Controller.

All customers who have signed up and subscribed for our services through an affiliate referral link shall be considered our Clients. For such Clients, our Terms of Use shall apply respectively:
